Terms of Service
New You Brands, Inc., a Florida corporation having its principal place of business at 4150 SW 28th Way, Fort Lauderdale, Florida 33312, and its affiliate companies, including but not limited to, Great HealthWorks, Inc. (collectively, the “Company”), have made available to me the photos, videos, and other content (the “Content”) captured at the 2025 New You Beauty Awards (the “Event”) through the third-party site https://www.pixieset.com (which site is operated by Pixieset Media Inc.) (the “Site”). By clicking “download” and downloading the Content available on the 2025 New You Beauty Awards Pixieset Collection (the “Collection”), I agree as follows:
1. My use of the Site is subject to all applicable laws and regulations, as well as the Site’s Terms of Service and Privacy Policy. Information submitted by me to Company is also subject to Company’s Privacy Policy located at https://www.newyou.com/privacy-policy/.
2. Company hereby grants to me a limited, non-exclusive, non-transferable, revocable, royalty-free, personal license, to use the Content solely for non-commercial purposes on my personal social media accounts (the “Permitted Use”). I shall not alter the Content in any manner whatsoever and I shall only use the Content for the aforementioned Permitted Use. Company is the sole and exclusive owner of the Content and I acknowledge that I shall not acquire any ownership rights in any of the Content from or as a result of any and all use of the Content by me.
3. I will defend, indemnify, and hold harmless Company, its affiliates, and its and its affiliates’ officers, directors, managers, shareholders, partners, agents, and employees against any and all liabilities, losses, demands, costs, and expenses, including attorney's fees and legal costs, that arise out of or in connection with third-party claims related to (i) breach by me of these Terms of Service; and/or (ii) my negligent use or willful misuse of the Content.
4. These Terms of Service constitute the sole and entire agreement regarding the subject matter herein, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter. I may not assign these Terms of Service without the prior written consent of Company. These Terms of Service will be binding on and will inure to my benefit and the benefit of Company and their respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. All matters arising out of or relating to these Terms of Service will be governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice or conflict of law provision or rule. I hereby irrevocably consent to the exclusive jurisdiction of the courts located in Broward County, Florida.
